Draft Direct Marketing Code – A Call for Your Views

On 8th January the Information Commissioner’s Office published its long-awaited draft Direct Marketing Code of Practice. The ICO is required to produce a direct marketing code of practice under the Data Protection Act 2018.
The public consultation on the Code close on 4th March 2020.
It covers more than traditional forms of direct marketing, extending to more advanced techniques such as online behavioural advertising, social media targeting, mobile apps and location-based marketing.
The draft code is aimed at providing practical guidance and to promote good practice for direct marketing purposes in compliance with data protection and ePrivacy rules (UK PECR). It anticipates those using the code will be familiar with key data protection and PECR terms and concepts.
The code will have statutory status and adhering to it will be seen as a key measure of compliance with data protection laws.
